1. Acceptance of Terms

By accessing or using SurfRank's website, platform, APIs, or any other services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use the Services. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Services

SurfRank provides AI visibility analytics services that allow users to:

• Track brand mentions and visibility across multiple AI engines (ChatGPT, Gemini, Perplexity, Claude, Grok, DeepSeek, Meta AI, and others)
• Monitor and analyze AI-generated responses related to their brands, products, and competitors
• Receive visibility scores, sentiment analysis, and competitive insights
• Access historical tracking data, reports, and recommendations

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice.

3. User Accounts

To use certain features of the Services, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

4. Subscription Plans and Billing

SurfRank offers various subscription plans with different features and pricing. By selecting a paid plan, you agree to the following:

• Billing Cycle: Subscriptions are billed on a recurring basis (monthly or annually) according to the plan you select
• Payment: You authorize us to charge your designated payment method for all fees associated with your subscription
• Renewals: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date
• Price Changes: We may change our prices with at least 30 days' notice. Your continued use after a price change constitutes acceptance
• Refunds: Refund requests are handled on a case-by-case basis. Contact our support team for assistance

Free plan users are subject to usage limits as described on our pricing page.

5. Acceptable Use

You agree not to use the Services to:

• Violate any applicable law, regulation, or third-party rights
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools (bots, scrapers, crawlers) to access the Services beyond the provided APIs
• Reverse engineer, decompile, or disassemble any part of the Services
• Interfere with or disrupt the integrity or performance of the Services
• Transmit viruses, malware, or other harmful code
• Resell, redistribute, or sublicense access to the Services without our written consent
• Use the Services to harm, mislead, or defame others

6. Intellectual Property

All content, features, and functionality of the Services — including but not limited to text, graphics, logos, icons, images, software, scoring algorithms, and data compilations — are the exclusive property of SurfRank Pte. Ltd. and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any content you submit to the Services (such as brand names and website URLs). By submitting content, you grant SurfRank a non-exclusive, worldwide, royalty-free license to use that content solely for the purpose of providing the Services.

7. Data and Accuracy

SurfRank provides visibility scores, analytics, and insights based on data collected from third-party AI engines. While we strive for accuracy:

• AI engine responses may vary over time and between sessions
• Visibility scores are approximations based on our proprietary methodology
• We do not guarantee that our data reflects real-time AI engine behavior
• Third-party AI engines may change their responses, APIs, or policies without notice

The Services are provided for informational purposes and should not be the sole basis for business decisions.

8. Limitation of Liability

To the fullest extent permitted by applicable law, SurfRank and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities
• Cost of procurement of substitute services
• Any damages arising from your use or inability to use the Services
• Any unauthorized access to or alteration of your data

In no event shall our total liability exceed the amount you paid for the Services in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure, or that any defects will be corrected.

10. Indemnification

You agree to indemnify, defend, and hold harmless SurfRank and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may terminate or suspend your access to the Services immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the Services will immediately cease
• We may delete your account and data in accordance with our Privacy Policy
• Any provisions of these Terms that by their nature should survive termination will remain in effect

You may terminate your account at any time by contacting our support team or using the account settings in the platform.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Singapore.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website and updating the effective date. Your continued use of the Services after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
